Article 78 Proceedings

These proceedings are initiated in the New York State Supreme Court to challenge decisions and actions by state officials or administrative agencies. Article 78 matters generally review issues like the following:

  • Whether a state official or agency performed a duty required by law
  • Whether a state official or agency acted, is acting, or is about to act without or in excess of jurisdiction
  • Whether a state official or agency made a determination that was capricious, arbitrary, or in violation of the law
  • Whether sufficient evidence supported a determination made by a state official or agency after a hearing

Article 78 proceedings can be brought in instances of certain suspensions, revocations, or denials (e.g. pistol or liquor licenses), denials of Freedom of Information requests, and denial of zoning applications.
